Joseph intuitively understood how the American state worked. It had many faces and many competing authorities. Power in the . was, and remains, split in countless ways. Among federal, state, and local governments. Among legislative, executive, and judicial branches. Between civilian and military authorities. And among agencies that overlap and compete with each other all the time. While the government after the Civil War was getting more adept at implementing policies—the technology of governing was improving—policy making was wide open, responsive to outside voices and to the myriad people and institutions that could claim legal authority on any given issue. The distributed nature of American power almost begged its subjects to contest every decision. There was always someone else to turn to, and for Joseph, it seemed that persistence in this process could be leveraged into rights.

On 15 October 1787, Bounty left Deptford for Spithead , in the English Channel , to await final sailing orders.  [n 3] Adverse weather delayed arrival at Spithead until 4 November. Bligh was anxious to depart quickly, to reach Cape Horn before the end of the short southern summer,  but the Admiralty did not accord him high priority and delayed issuing the orders for a further three weeks. When Bounty finally sailed on 28 November, the ship was trapped by contrary winds and unable to clear Spithead until 23 December.   With the prospect of a passage around Cape Horn now in serious doubt, Bligh received permission from the Admiralty to take, if necessary, an alternative route to Tahiti via the Cape of Good Hope .
